Terms andconditions
The terms on which you may use this website. They are about the site itself. The work we do for clients is governed by a signed agreement for that project, not by this page.
Agreeing to this
By using this website you accept these terms. If you do not accept them, please do not use the site. We may change them, and the date at the top of this page changes when we do — continuing to use the site after that is acceptance of the changed version.
Nothing here is an offer
Everything on this site is a description of the work rather than an offer to do it, and no page here is a price. Nothing on the site forms a contract, and nothing said by the assistant does either.
Work becomes an agreement when it has been quoted and the quote has been accepted in writing, and the terms of the build itself — what is being delivered, by when, who owns what at the end, and what happens if either side wants to stop — live in that agreement. What happens to money is set out in the refunds and cancellation policy.
Using the site
You are welcome to read the site, use the assistant and send us an enquiry. Please do not: attempt to break it or gain access to any part of it that is not public; take it apart or copy it wholesale; use it to send anything unlawful, defamatory or abusive; impersonate anyone; or scrape it at a volume that affects other people using it.
Please also do not use the assistant to generate content that is unlawful, or hammer it in a way that costs us money for no purpose. It is a real service with a real bill behind it, and we may rate-limit or block use that is abusive rather than curious.
The assistant
The assistant on the start page is software. It is useful for working out where automation would save you time, and it is wrong sometimes, in the way all software of this kind is wrong sometimes. It generates its answers rather than looking them up, so it can be confidently incorrect.
Do not treat what it says as professional, financial, medical or legal advice, and check anything that matters with a person before you act on it. Nothing it says binds us: it cannot quote a price, agree a timeline or commit us to a piece of work, and if it appears to do any of those, it is wrong and clause 02 applies.
What you type into it is sent to Anthropic, whose model answers it. Do not put anything confidential into it. If you give it your name and email in conversation, that is treated as an enquiry and reaches our inbox — the privacy policy sets out exactly what happens to it. The form underneath reaches the same inbox, and so does an ordinary email, if you would rather not use it at all.
What belongs to whom
The site, its writing, its code, its artwork and its design are ours. Please do not republish them as your own. You may link to any page here, and you may quote a reasonable extract with attribution.
Anything you send us stays yours. By sending it you give us permission to use it for the purpose you sent it for — to reply to you, to prepare for a call and to quote. Nothing more.
Ownership of work we build for a client is dealt with in the agreement for that work, because it is the kind of thing that should be written down once, specifically, rather than assumed from a website.
Links and other people's sites
Where the site links somewhere else, we do not control that destination and we are not responsible for it. A link is not an endorsement, and the other site's terms and privacy policy apply once you are there.
Availability
We try to keep the site up and correct, and we cannot promise it will always be either. It is provided as it is. We may change it, take parts of it down, or stop offering it, without notice. The assistant in particular depends on a third-party service that may be slow, unavailable or changed without warning by the company that runs it.
Liability
Your attention is specifically drawn to this section, which limits our liability to you. It is written to be read, and this notice is given as contemplated by section 49 of the Consumer Protection Act 68 of 2008.
We are not liable for loss arising from your use of this site, from anything the assistant says, or from the site being unavailable, to the extent the law allows us to say so. We are not liable for indirect or consequential loss, or for lost profit, revenue, business or data.
Nothing here limits or excludes liability for fraud, for gross negligence, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Nothing here limits any right you have under the Consumer Protection Act where that Act applies to you.
If you break these terms
You are responsible for loss we suffer because you used the site in a way these terms do not allow — attacking it, scraping it, or sending unlawful content through it. This does not apply to ordinary use, and it does not apply to anything that was our fault.
Privacy and cookies
What we collect and why is in the privacy policy. What this site stores in your browser — which is nothing — is in the cookie policy. Both form part of these terms.
The law that applies
The law of the Republic of South Africa applies to these terms and to any dispute about them, and its courts have jurisdiction. If any part of these terms is found to be unenforceable, the rest of them continue to apply.
If you have a problem, please write to ai@miax.co.za before you do anything else. Most things are a misunderstanding and are fixed in one email.
